Temperd Ltd – Limited Warranty

Thank you for choosing the Temperd Cold Plunge. This limited warranty covers defects in materials and workmanship under normal use. It is given in addition to your statutory rights and does not replace them.

How Long the Warranty Lasts

The duration is set by who buys the product, not by where it is installed:

  • Private individuals (consumers): 2 years from the date of delivery.
  • Companies, sole traders and other legal entities: 1 year from the date of delivery.

The Temperd Commercial is normally bought by a business, so the 1-year term applies to it in most cases. If a private individual buys any model, including the Commercial, the 2-year consumer term applies. If a business buys a residential model, the 1-year business term applies.

Your Statutory Rights

For consumers in the European Union, this warranty is additional to the legal guarantee of conformity and does not reduce or limit it. Where the legal guarantee applies, remedies for a product that is not as described are provided free of charge, including any necessary transport, labour and materials.

What is Covered:

  • Manufacturing Defects: Any defects that arise due to issues in the production process, including structural issues, faulty parts, or problems with electrical components.
  • Operational Malfunctions: If the product ceases to function properly under normal usage conditions, such as temperature regulation failures or electrical malfunctions.

What is Not Covered:

This limited warranty does not cover the following circumstances:

  • Accidental Damage: Any damage resulting from misuse, accidents, neglect, or improper care (e.g., dropping the unit or exposing it to extreme conditions).
  • Unauthorized Modifications: Any damage caused by unauthorized repairs, modifications, or alterations to the product.
  • Improper Installation: Damages due to improper installation or failure to follow our provided instructions.
  • Environmental Damage: Rust, corrosion, or other damage caused by exposure to the elements, including extreme weather, chemicals, or improper storage.
  • Normal Wear and Tear: Regular usage marks, scratches, or aesthetic damage that do not affect the product’s functionality.

Who Pays What

On an approved claim we repair or replace the defective part or product, at the discretion of Temperd Ltd. Replacement parts or units may be new or refurbished but will function as new. Costs break down as follows:

  • Replacement parts: Temperd pays on an approved claim. On a claim that is not covered, parts are quoted and paid by the customer after written approval.
  • Standard shipping of replacement parts: Temperd pays on an approved claim.
  • Return of a failed part: If we ask for the part back, Temperd arranges and pays for its return.
  • Collection and redelivery of a whole unit: Arranged by Temperd. The cost is agreed and confirmed with you in writing before we collect.
  • On-site labour, travel, access equipment and reinstallation: Not included unless agreed with you in writing in advance.

You will not be charged for warranty service without written confirmation from you first. Where the EU legal guarantee applies to a consumer purchase, it takes precedence over this cost breakdown.

Warranty Claim Procedure:

If you encounter any issues with your Temperd Cold Plunge, please follow these steps to submit a warranty claim:

  1. Contact Us: You can initiate a claim by contacting our Customer Support team via support@temperd.co. Be prepared to provide:
  • Your order number or proof of purchase.
  • Detailed description of the issue.
  • Photos or videos showing the problem.
  • Any claims that you may have for visual defects must be issued when receiving the unit, by photo proof while the unit is still on the transportation pallet on the day of receipt.
  1. Review and Assessment: Once we receive your claim, our technical support team will assess whether the issue qualifies for warranty coverage. You may be asked for additional information or to conduct basic troubleshooting steps.
  2. Repair or Replacement: If your product qualifies for warranty service, we will repair or replace the defective part or product on the cost terms set out above.

Exclusions and
Limitations:

  • This warranty is valid only for products purchased directly from Temperd Ltd or authorized dealers.
  • The warranty term is set by the type of buyer, as described under How Long the Warranty Lasts.
  • The warranty is valid only for the original purchaser and is not transferable, unless otherwise agreed.
  • To the extent permitted by law, Temperd Ltd is not responsible for any incidental or consequential damages resulting from the use of the Temperd Cold Plunge. This does not affect the statutory rights of consumers.

For customers who wish to extend the protection period, we offer optional extended warranty packages. Contact our customer service team for details on available plans and pricing.
